Keith Oliver Criminal Law secured another dismissal of criminal charges for one of their clients this week. Their client was charged with theft of moveable property stemming from an incident in one Monmouth County’s shore towns. The allegations stem from an incident where the officer alleged they witnessed the client remove certain property from an individual’s front lawn. The client was charged with theft of moveable property and based on the value of the property, they were charged with a disorderly persons offense. That is New Jersey’s version of a misdemeanor. So, if convicted of this offense, the client would have been scarred with a criminal record, facing a fine up to $1,000 and even jail time. To make matters worse, our client was not a citizen and based on the nature of the charges, the client could have been facing deportation proceedings as well.
Once the attorneys received the police reports, the MVR and the footage from the body camera that the arresting officer was wearing it became apparent that the prosecution was going to have a difficult time proving their case beyond a reasonable doubt. They were able to formulate a defense for their client and after extensive negotiations with the prosecution, they agreed to dismiss the charges. Meaning, that charges were not simply downgraded to a Borough Ordinance but dismissed outright. Since the charges were dismissed outright and not part of a plea deal, the client was also able to petition the court for an expedited expungement of their underlying arrest. So our client went from potential facing jail time, high fines and even deportation proceedings, to having the charges dismissed outright and expunged from her record.
