As touched upon earlier, in 1999 the legislature was forced to create a new section of the criminal code in order to better prosecute prescription drug charges. The subsection that was created is NJSA 2C:35-10.5. This subsection will cover the possession of prescription legend drugs and the distribution of prescription legend drugs. It is important to note here that a Defendant charged with a prescription legend drug offense under NJSA 2C:35-10.5 will also most likely be charged with a similar offense under NJSA 2C:35-10 and/or NJSA 2C:35-5.
