The vast majority of times the controlled dangerous substance in question is marijuana but that is not always the case. Sandy Hook has seen its fair share of cocaine, heroin, MDMA and of recent times, alcohol related arrests. Although this offense is considered a misdemeanor under Federal Law, if convicted, it calls for a term of imprisonment up to one year and shall be fined not less than $1,000 or both. With that being said, if the individual has a prior criminal history for the possession of a controlled dangerous substance, the individual shall be sentenced to a term of imprisonment for not less than 15 days and fined not less than $2,500. Furthermore, if the individual has two or more convictions for drug possession, the individual shall be sentenced to a term of imprisonment for not less than 90 days but not more than 3 years, and shall be fined a minimum of $5,000. In order for these enhanced felony penalties to apply, the government must meet the strict guidelines of 21 U.S.C. § 851.
