Freehold Man Accussed of Aggravated Sexual Assault

55 Year Old Male Alleged to have Sexually Assaulted 14 Year Old

Monmouth County Prosecutor, Christopher Gramiccioi, has announced that they have arrested and charged a Freehold Township man with among other things, aggravated sexual assault and endangering the welfare of a child.

The Defendant, a fifty-five (55) year old male, is alleged to have lured the victim, a fourteen (14) year old female, from a local convenience store to a local apartment in Freehold so that he could sexually assault her. Things did not end their, the Defendant is also alleged to have photographed the girl as well during the encounter. It is unclear at this point in time whether or not the Defendant actually knew his victim but once the encounter was over, he then drove her home, which wasn’t till the next day.

The Defendant was taken into custody later that evening and formally charged with one count of aggravated sexual assault in the first degree, multiple counts of endangering the welfare of a child, including manufacturing child pornography in the first degree and one count of luring in the second degree. The Defendant, who was employed as a home health aid for the elder, was taken to the Monmouth County Jail, where he will be pending a Central Judicial Processing Hearing (CJP), where he will most likely be informed that the State is filing for a Detention Hearing. If that is to occur, the Defendant will be scheduled for a Detention Hearing, whereby the State will be seeking to convince the Judge that the Defendant must be detained in the Monmouth County Jail, without bail, pending trial. Once the bail hearing is conducted, the Defendant’s case will be marked for the Grand Jury.

Aggravated Sexual Assault Charges in New Jersey

Aggravated Sexual Assault, is New Jersey’s version of “Rape”. This is a very complex offense and it tends to encompass a wide array of potential conduct. Pursuant to NJSA 2C:14-2, anyone convicted of this offense would be subject to an extended first degree term of incarceration, which could range anywhere from ten to thirty years. Furthermore, this offense falls under the No Early Release Act (NERA), which in essence mandates that anyone convicted of one of their enumerated offenses be required to serve at least 85% of their sentence before they could become eligible for parole. Also, if the victim in the case is under the age of thirteen (13) at the time of the incident, if convicted, the Defendant must be sentenced to a term of Life in Prison.
