Charged with Domestic Violence in Mercer County?
A forty year old male from the City of Trenton was arrested and charged with several acts of domestic violence following an incident that took place in early February. Apparently during the early morning hours of February 6th the Defendant showed up at the victims house unannounced, which sparked a heated verbal argument. That verbal argument quickly escalated into a physical altercation when the Defendant punched the victim in the face. Upon being punched in the face, the victim attempted to retreat back inside her home at which point the Defendant kicked in the door and continued assaulting her. It wasn’t until the victim called the police that the Defendant stopped the assault and fled the scene.
Since the Defendant fled the scene, the officers were only able to issue a warrant for his arrest on the sixth. However, on the eleventh the officers were able to finally catch up to the Defendant and place him under arrest. The Defendant was formally charged with simple assault, aggravated assault, criminal mischief, unlawful possession of a weapon and possession of a weapon for unlawful purpose. Also, it has been reported that the Defendant was also arrested earlier this year on heroin possession and distribution charges.
Trenton Aggravated Assault Lawyers
Aggravated assault is considered an indictable offense, which is New Jersey’s version of a felony. Pursuant to NJSA 2C:12-1b, aggravated assault can either be considered a 2nd, 3rd or 4th degree felony offense. The type of injury in question and the “status” of the victim (i.e. police officer) is what will determine what degree a Defendant is charged with. It is also important to note here that pursuant to the statute, a Defendant can be charged with the aggravated assault based on an attempted to cause theory. In other words, if the Defendant attempted to cause serious bodily injury to another but failed to actually cause serious bodily injury, they can still be charged with aggravated assault in the 2nd degree.
