NJ State Police Conducting DUI Checkpoint at PNC Bank Art Center
Holmdel Township is joining the long list of towns throughout Monmouth County this weekend by conducting a driving while intoxicated checkpoint. The DWI checkpoint will be conducted on Saturday, August 25, 2018 at the PNC Bank Art Center. It is unclear at exactly what time this checkpoint will be begin but with the the bands Five Finger Death Punch and Breaking Benjamin scheduled to perform into the late hours of Saturday night, it appears that the checkpoint will be conducted towards the end of their performances. Unlike most of the other DWI Checkpoints that have been conducted in Monmouth County this year, the New Jersey State Police have not announced where exactly this roadblock will be conducted.
What Happens at a DWI Checkpoint?
During the road stop, the officers will be conducting a brief questioning of the driver in an effort to determine if they are impaired. Impaired includes not only alcohol but drugs like marijuana, cocaine, heroin and prescription drugs as well. If it is determined that the driver could possible be under the influence, they must be removed from the vehicle so that they could be placed to the Standardized Field Sobriety Tests (SFST). These tests are used in an effort to determine whether there is probable cause to believe that the individual is driving while intoxicated. If the individual fails the SFST’s, then the individual will be asked to report to the New Jersey State Police Barracks, which is located directly off the Garden State Parkway in Holmdel so that they could submit a breath sample into the Alcotest Machine. If the individual’s breath sample is above a .08%, they will be placed under arrest and formally charged with driving while intoxicated. If that occurs, they will be processed and released upon a summons to appear in the Holmdel Municipal Court to answer for the charges. If the individual refuses to submit a breath sample into the Alcotest Machine, they will be charged with not only refusing to submit a breath sample but driving while intoxicated as well, based on their performance on the Standardized Field Sobriety Tests.
How are DUI Checkpoints Legal?
In order for the checkpoint to be valid, strict procedures must be followed. Some of the procedures include the following:
- The designated location for the checkpoint must be based on information collected on previous DWI arrests;
- They must give the public advanced notice of the DWI Checkpoint;
- They may only stop a vehicle for a brief period of time to look for signs of impairment.
