The Hightstown Police Department has announced that they have arrested and charged the Robbinsville School Board President with driving under the influence as well as several other ancillary charges. According to the details that have been released at this point, the Defendant was pulled over in Hightstown around 8:30 Sunday evening for an alleged motor vehicle infraction. The incident took place in the vicinity of Hightstown High School. It has yet to be reported but it is presumed that once the Defendant was pulled over at some point in time he was removed from his vehicle in order to perform the Standardized Field Sobriety Tests, also known as SFST’s the legal profession. These test are used in an effort to gage whether the officers have enough probable cause in order to arrest the suspect and request that they submit a breath sample.
Based on the reports so far, the Defendant was placed under arrest and transported back to the Hightstown Police Department so that further tests could be conducted. While back at the police station the Defendant refused to submit a breath sample and as such he was formally charged with refusal to submit to a breath sample, driving while intoxicated, driving while intoxicated in a school zone as well as several other ancillary motor vehicle violations. Pursuant to John’s Law, the Defendant was released into the custody of a sober driver. He was released on a summons with a notice to appear in the Hightstown Municipal Court in the future to answer for the charges.
Provided this is the Defendant’s first DWI offense, he will be facing a mandatory minimum of a one year loss of license on the DUI in a school zone charge, a mandatory three month loss of license on the DUI charge (since their was no readings) and a mandatory seven to twelve month loss of license on the refusal to submit to a breath sample charge.
