Marijuana Charges in Ewing New Jersey
As touched upon earlier, marijuana charges are by far one of the most common charges litigated in the Ewing Municipal Court. If you have been charged with a violation of NJSA 2C:35-10a(4), which is the statute for possession of marijuana under 50 grams, in Ewing then your charges will be litigated in the Ewing Municipal Court. The Ewing Municipal Court is located at 2 Jake Garzio Drive and it will be in session every:
- Monday at 5:00 pm
- Wednesday at 8:30 am & 1:00 pm
- Thursday at 8:30 am
Since possession of marijuana under 50 grams is a disorderly persons offense (misdemeanor), anyone convicted of this offense would be subject to the following penalties: up to six months in the Mercer County Jail, up to a $1,000, fess and assessments ranging up to $800, a criminal record, court ordered drug rehab, community service and a six month loss of driving privileges. With that being said, there is a diversionary program known as the Conditional Discharge Program which certain Defendant’s charged with this type of offense may be able to take advantage of. If they are eligible and if defense counsel can convince the Judge that their client is a good candidate, they would have the opportunity to walk away from these charges without ever serving a day in jail and without a criminal record. Heroin Charges in Ewing New Jersey
If you have been charged with a drug like heroin, cocaine, LSD, Molly, Ecstasy or Mushrooms in Ewing, New Jersey then you will be facing a third degree felony. Basically every drug charge outside of a small quantity of marijuana will be a third degree felony offense. All third degree felony drug charges arising in the Township of Ewing will be transferred to the Mercer County Superior Courthouse for resolution. The Mercer County Superior Courthouse is located at 400 South Warren Avenue in Trenton. These charges will be prosecuted by the Mercer County Prosecutor’s Office unless they can be convinced to remand the charges back to the Ewing Municipal Court. If that is to occur, then the third degree felony drug charges will be downgraded to a disorderly persons offense (misdemeanor). Some of the most common downgraded felony drug charges include the possession of drug paraphernalia, loitering for the purposes of obtaining CDS or failure to turn over CDS. If the charges are downgrades, the potential penalties are equivalent to those of a possession of marijuana under 50 grams (see above). Anyone charge with a third degree felony drug charge in New Jersey will be facing the following penalties: three to five years in a state prison, a fine up to $35,000, a felony drug conviction, court ordered rehab, community service, probation and a six month loss of license. Similar to the possession of marijuana under 50 grams charges, a Defendant charged with a third degree felony drug offense may be eligible for the pretrial intervention diversionary program. Just like the conditional discharge program, if the Defendant successfully completes the program the charges will be outright dismissed. If you have any question please do not hesitate to contact us.
